ANTI-SPAM POLICY

General Statement:

Evergreen Trading (“ET”) is committed to permission-based email practices, and as a result has established this no-tolerance Anti-Spam Policy. For purposes of this Anti-Spam Policy, “you” or “your” refers to you as a user of the ET website (www.evergreentrading.com) (the “Website”). “We”, “our” or “us” refers to ET.

2. What is Spam?

Spam is commercial email or unsolicited bulk email, including “junk mail”, which has not been requested by the recipient. It is intrusive and often irrelevant or offensive, and it wastes valuable resources. Spam messages are the opposite of permission-based email, which are normally anticipated, personal, relevant and/or associated with a pre-existing business or personal relationship. Inappropriate newsgroup activities, consisting of excessive posting of the same irrelevant materials to several newsgroups, are also deemed to be spam.

3. Permissible Emails:

 

You may receive emails from ET or the Website under the following circumstances:

Requests for information;

Responses to your inquiries regarding the status of a transaction;

Thanking you for your valued business;

Advertisements for ET’s products, services, changes in services or in new product availability;

Advertisements for third party products and services where we have determined that such product or services may be of interest to our customers; and

Current topics that we have determined may be of interest to our customers and vendors.

 

4. Guidelines to Prevent Spam:

ET has implemented the following guidelines for email delivery in order to prevent spam and to comply with applicable law.

All emails sent to you by ET will clearly identify ET or the Website as the sender. FROM/SENDER: someone@evergreentrading.com;

The subject line of any email you receive will always accurately describe the subject matter of the email;

Any email from ET will include the ability to unsubscribe from future email messages;

Unsubscribing will ensure the customer is removed from all lists of ET;

All emails sent to you directly by ET will include valid postal address information in the footer;

All third party marketing partners are required to comply with this Anti-Spam Policy; and

Emails sent to you directly by ET will include an email address and a physical address where you can send suggestions, complaints or other correspondence.

 

5. Compliance with this Anti-Spam Policy:

By using the Website, you agree to comply with this Anti-Spam Policy. Specifically, you agree not to use the Website to send unsolicited email or bulk email, whether or not for commercial purposes. ET reserves the right to determine in its sole discretion what constitutes actionable spam, as well as what measures are necessary in response to such spam activities.

Without limiting the general prohibitions against all spam activities, you are expressly prohibited from using the Website to engage in the following activities:

(a) Use of false headers, or other false information, to identify the point of origin or the transmission path of the email, or to hide the true origin of the email sender;

(b) Unauthorized use of a third party’s internet domain name without the permission of such third party, to make it appear that the third party was the point of origin of the email;

(c) Use of any false or misleading information in the subject line of the email;

(d) Sending email to mailing lists or distribution lists, which then send indirectly to various other email addresses;

(e) Importing for use a purchased list of any type;

(f) Continuing to email anyone who has asked to be deleted from your mailing list; and

(g) Assisting any person in using the Website for any of these previously mentioned activities.

 

6. Measures to Enforce the Anti-Spam Policy

Anyone found to be using the Website for spamming purposes may, at ET’s discretion, be immediately cut off from use of the Website and/or fined US$ 1,000 per occurrence, with no refund of fees that have been paid.

ET does not attempt to censor any content, or to curtail the business of its customers. However, spam activities do not fall within uses authorized by ET, and will not be tolerated.

 

7. Reporting Spam

If you believe that you have received spam from or through ET’s Website, please send a complaint from your email account along with the unsolicited email, with completed header, to info@evergreentrading.com. Please provide any other information that you believe may help us in our investigation. ET does not investigate or take any action based on “anonymous” spam complaints.

 

8. Changes to Anti-Spam Policy

ET reserves the right to modify this Anti-Spam Policy at any time. When it does, ET will revise the “last dated” date on the first page of the Anti-Spam Policy and will post the changes on our Website.
